    Chris,

    Our main concerns are simple:
    - The needs and service demands of plan sponsors are growing as the largest generation in history gets ready to retire, for the longest post-work period in history — decades
    - The complexity of markets, technology and regulatory factors is accelerating
    - The science of behavioral economics has proven that our minds instinctively and impulsively avoid paying for something short-term where the benefits are long-term. It also proves that more detail actually hinders better decision-making.

    This would predict bad outcomes. The problem with bad outcomes in retirement finances is that the government (all of us) ends up paying.

    We have been advocates for full and fair fee disclosure for over 20 years. It is the law.

    However, we have been appalled by the reactive/impulsive politicization and demonizing that seem to be the basis for the policy. There was no study and critical-thinking, evidenced-based discussion or problem-solving around these issues. Nor were ideas tested and tried in a controlled setting first. Imagine if FDA policy we handled this way! It was highly irresponsible.

    If you go to the doctor in pain and tell her what to do — does she do it? Same with attorney, accountant, etc.

    Sadly, negative emotions such as immediate-fear and paranoia ruled the popular (mainly “mud slinging”) discussion — even by some of the most vocal advisors. The policy makers, as they must, acted to quiet the loudest voices. No one’s to “blame” it’s human nature to act on immediate-fear – first, last and only.

    In terms of handling people’s life savings and supporting struggling employers, the 401(k) “haters” won. Guess who lost? All of us.
